These terms apply to purchases of goods from Drover Cycles, including purchases made through our online shop.
Please read them before placing an order.

In these terms, "Drover Cycles", "we", "us" and "our" mean Drover Cycles (Hay on Wye) Ltd.
2. Our online shop
Our ecommerce platform is provided by Citrus-Lime Ltd.
Products displayed on our website are invitations to place an order rather than an offer by us to sell those products.
When you place an order, you are offering to purchase the goods on these terms.
A contract is formed when we accept your order. An automated acknowledgement that we have received an order does not necessarily mean that we have accepted it.
3. Products
We take reasonable care to ensure that product descriptions, photographs, specifications and prices are accurate.
Colours and appearance may vary slightly depending on your screen, and manufacturers may occasionally make minor changes to specifications.
Where a product has been obviously mispriced or materially incorrectly described, we are not obliged to supply it at the incorrect price or specification. If this happens after you place an order, we will contact you and give you the opportunity to proceed on the correct basis or cancel for a full refund.
4. Availability
All orders are subject to availability.
Although our stock systems are designed to provide accurate availability information, occasionally an item may become unavailable after an order has been placed.
If we cannot supply an item, we will contact you and refund any amount paid for that item.
5. Prices and payment
Prices shown on our website are in pounds sterling and include VAT where applicable unless stated otherwise.
Delivery charges and any other applicable charges will be shown before you complete your purchase.
Payment must be made using one of the payment methods offered at checkout.
We may use third-party payment providers to process payments securely.
6. Delivery
Available delivery methods, charges and estimated timescales are shown on our website and during checkout.
We aim to dispatch goods promptly but delivery estimates are not guaranteed unless we expressly agree otherwise.
Unless a different period has been agreed, goods will be delivered without undue delay and within the period required by applicable consumer law.
Please check the delivery address carefully when ordering.
Risk in goods passes to you when they are delivered to you or to a person identified by you to receive them, except where applicable law provides otherwise.
7. Click & Collect
Where Click & Collect is available, we will let you know when your order is ready for collection.
Please do not travel to collect an order until you have received confirmation that it is ready.
We may ask for proof of order and appropriate identification when goods are collected.
8. Ownership
Ownership of goods passes to you once we have received payment in full and the goods have been delivered or collected, as applicable.
9. Your right to cancel an online order
Consumers purchasing at a distance will normally have a statutory right to cancel an order for goods within 14 days after the day the goods are received, subject to legal exceptions.
If you wish to exercise this right, you must tell us within the applicable cancellation period.
You then normally have a further 14 days in which to return the goods.

10. Our additional 30-day returns policy
In addition to your statutory rights, we offer a 30-day returns policy for most unused goods.
Conditions and exclusions are explained in our Refund Policy.
Our voluntary returns policy does not affect your statutory rights.
11. Faulty goods
We are under a legal duty to supply goods that conform to the contract.
Goods must, among other things, be of satisfactory quality, fit for their intended purpose where applicable and as described.
If goods are faulty, your rights may include a refund, repair or replacement depending on the circumstances.
Nothing in these terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.
12. Manufacturer warranties
Some products may also be supplied with a manufacturer's warranty.
A manufacturer's warranty is additional to, and does not replace or reduce, your statutory rights against us as the retailer.
We may assist you in dealing with a manufacturer or distributor where this provides a convenient way to resolve a warranty issue.
13. Bicycles and assembly
Bicycles may require final setup or adjustment following transport or during normal initial use.
Where a bicycle is delivered partly assembled, you must follow the supplied instructions and ensure that all required assembly and safety checks are completed correctly before riding.
If you are uncertain about assembly or adjustment, please contact us or a competent cycle mechanic before using the bicycle.
Nothing in this section excludes our responsibility for supplying goods that meet your statutory rights.
14. Age-restricted or specialist products
Certain products may be subject to legal restrictions or may require appropriate knowledge, installation or use.
Where applicable, you are responsible for complying with legal age requirements and using products in accordance with manufacturer instructions.
15. Services
Where we provide workshop, bike fitting or other services, we will carry out those services with reasonable care and skill.
Any quotation or estimate will be based on the information reasonably available at the time.
If additional work becomes necessary, we will seek your authority before carrying out material additional chargeable work unless otherwise agreed.
16. Our liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill.
We are not responsible for business losses suffered by a consumer, including loss of profit, revenue or business opportunity.
Different terms may apply to purchases made wholly or mainly for business purposes.
17. Events outside our reasonable control
We will not be responsible for delay or failure caused by circumstances outside our reasonable control.
Where such circumstances materially affect an order, we will take reasonable steps to minimise the effect and will contact you where appropriate.
Your statutory rights remain unaffected.
18. Personal information
We process personal information in accordance with our Privacy Policy.
Our websites also use cookies and similar technologies as explained in our Cookie Policy.

20. Changes to these terms

The terms applying to an order will normally be those in force when the contract for that order was made.
21. Governing law
These terms and contracts between us are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you will also retain any mandatory protections and rights available to you under applicable law.
The courts of England and Wales will have jurisdiction, subject to any rights consumers have to bring proceedings in another part of the United Kingdom where applicable.
